К Вопросу О Признании Культуры В Качестве Объекта Преступления Геноцида В Международном Праве

Abstract

В статье рассматривается культура в качестве гипотетического объекта преступления геноцида. Автор делает исторический экскурс в процесс создания текста конвенции «О предупреждении преступления геноцида и наказании за него», ссылаясь на travaux préparatoires, и указывает на имевшие место предложения расширить рассматриваемый объект. В работе проанализированы точки зрения ученых и практика Международного трибунала по бывшей Югославии и сделаны соответствующие выводы.
