О Формировании Внутреннего Убеждения Государственного Обвинителя

Abstract

В статье рассмотрены сущность внутреннего убеждения прокурора и этапы его формирования. Проанализировано значение внутреннего убеждения как для поддержания государственного обвинения, так и для отказа от него в суде. Указаны особенности формирования внутреннего убеждения прокурора, поддерживающего обвинение в рамках рассмотрения уголовного дела, и возникающие при этом трудности. Особое внимание уделено необходимости обеспечения формирования непредвзятого убеждения по поводу виновности или невиновности лица в совершении преступления.
