Апелляционное И Кассационное Судопроизводство По Делам Об Административных Правонарушениях: Вопросы Теории И Практики

Abstract

В статье анализируются правила рассмотрения вышестоящими судебными инстанциями жалоб и протестов на постановления и решения судов первой инстанции по делам об административных правонарушениях. Автор приходит к выводу о том, что современное законодательство и перспективы развития ревизионных правил пересмотра судебных актов имеют фундаментальные погрешности, которые можно устранить путем принятия Концепции процессуального законодательства по делам об административных правонарушениях.
