Медиация Как Альтернативный Способ Урегулирования Индивидуальных Трудовых Споров: Проблемы И Перспективы Развития

Abstract

В статье рассматриваются вопросы посредничества при рассмотрении и разрешении трудовых споров. Автором определяется роль медиаторов, сформулированы требования к ним, анализируется их компетенция. В работе сделаны выводы, во-первых, о важности введения медиации как обязательного этапа разрешения индивидуальных трудовых разногласий и споров; во-вторых, о целесообразности пересмотра требований к медиаторам в части введения проверки отсутствия у них судимости; в-третьих, о необходимости введения требования о наличии у медиаторов высшего юридического образования; в-четвертых, о возможности включения в компетенцию медиатора рассмотрения и разрешения коллективных трудовых споров.
