Правовое Положение Прокурора В Суде Апелляционной Инстанции По Уголовным Делам

Abstract

В статье исследуется процессуальное положение прокурора в суде апелляционной инстанции по уголовным делам, которое отличается от процессуального положения осужденного, защитника, потерпевшего, других участников уголовного процесса. Сделан вывод о том, что в суде апелляционной инстанции прокурор, оставаясь стороной обвинения, доказывает суду апелляционной инстанции, в том числе и путем предоставления дополнительных доказательств, то, что преступное деяние, совершенное подсудимым, имело место, он виновен в его совершении и поэтому должен понести предусмотренное уголовным законом наказание. Подобная деятельность представляет собой не что иное, как уголовное преследование.
