Abstract

В статье рассматриваются проблемы, связанные с принятием решения при рассмотрении вопроса о наличии или отсутствии состава преступления, предусмотренного ст. 119 УК РФ (угроза убийством или причинением тяжкого вреда здоровью). Представлено авторское видение сложившейся ситуации, которое связано с принятием уголовнопроцессуального решения при оценке основания и повода для возбуждения уголовного дела.
