Abstract

В статье рассматриваются вопросы, касающиеся нарушения норм Уголовно-процессуального кодекса РФ при изъятии доказательств по уголовному делу, порядка признания доказательств недопустимыми, применения американского правила «о плодах отравленного дерева» в уголовном процессе России, отношения Европейского суда по правам человека к доказательствам, полученным с нарушением законодательства.
