Abstract

Статья посвящена анализу применения судами общей юрисдикции при уголовном судопроизводстве постановлений Европейского суда по правам человека и норм Европейской конвенции о защите прав человека и основных свобод. Проведенное исследование позволяет утверждать об уровне развития уголовного судопроизводства в России в контексте приобщения к международным европейским стандартам защиты прав человека. Проведен системный анализ национального законодательства в сфере позиций Верховного суда РФ в процессе имплементации европейских стандартов в национальное уголовное судопроизводство. Данная проблематика имеет многогранный характер.
