Abstract

Предпринимательская деятельность любой коммерческой организации подвержена колоссальному числу рисков. Для того чтобы минимизировать их, законодатель предоставляет участникам гражданского оборота различные правовые формы и средства, посредством которых они могут распределять риски и управлять ими. В свете ужесточения правовой регламентации деятельности организаций в гражданском и уголовном законодательстве актуальным представляется рассмотрение в статье привлечения к субсидиарной ответственности контролирующих должника лиц в рамках дела о банкротстве.
