Abstract

Addressing to researching the issue of labour remuneration of the persons incumbent municipal positions on a permanent basis results from the judicial practice development of bringing them to criminal responsibility and recovery of bonuses, incentives and other payments as unjust enrichment, if decisions on their awarding were taken by them independently. It also entails administrative responsibility for misuse of public funds and early termination of office owing to loss of confidence. Such practice is due to shortcomings in the legal regulation of the remuneration of this category of officials at regional and municipal levels, researching them will provide for proposals for its improvement. Another reason is the insufficient level of knowledge of legislation and judicial practice, the generalization of which in this article will make it possible to avoid adverse consequences in municipal administration. Also, the research revealed the ratio problem between the regional and municipal regulation of labor remuneration, when the RF entities seek to normalize the size of the remuneration of persons incumbent municipal positions and limite them through the introduction of limit values. The article provides these rule-making practices as measured against the judicial practice materials of the RF Supreme Court. The revealed approaches and models of legal regulation of labour remuneration of persons incumbent municipal positions on a permanent basis indicate the need for its unification at the federal level.
