Interaction as a type of relationship between local governments and public associations: theoretical and legal foundations

Abstract

Aim: to research theoretical and legal foundations of interaction of local governments and public associations, to give the definition to the concept and formulate the features of this interaction. To achieve the above aim, analysis and deduction methods and formal legal method were used to research the rules of law, fixing the local government institutions and public associations. Results and scientific novelty: according to the results, the research revealed that the interaction between local authorities and public associations is a variety of relationship between the given subjects. However, not every relationship is an interaction of local authorities and public associations. The issue is still debated in the constitutional and municipal law science. To resolve the problem revealed the author defined the concept of interaction between local authorities and public associations – it is an active, bilateral, joint and coordinated relationship of these entities in exercising rights and (or) performing duties with the aim to address the issues of local government at local level and to implement the statutory goals of public associations. To add, the author identified characteristic features of such interaction, which are new to the constitutional and municipal law science. They are joint nature of activities undertaken; coordination of activities; active and bilateral nature of activities (making decisions or taking actions affecting the other interaction entity; feedback in interaction process); similar goals of interaction subjects (resolving issues of local importance for local governments, implementing statutory goals for public associations). The formulated conclusions provide basis for the scientific perception of legal aspects of interaction between local authorities and public associations, and are also to adjust the law-making activities of municipal authorities on the issues of legal regulation of interaction with public associations.
