Regulating foreign subsidies that distort competition – an overly ambitious goal?

Abstract

Regulation 2022/2560 on foreign subsidies distorting the competition aims to ensure a level playing field on the Internal Market by eliminating the negative effects on competition of the subsidies granted by third countries to companies active in the EU. To achieve this objective, the Regulation includes powerful tools enabling the European Commission to analyze mergers and public procurement offers, as well as a general instrument targeting companies active on the Internal Market, which could benefit from external subsidies. Following investigations, the European Commission is empowered to accept commitments from companies and impose measures, which could include the full reimbursement of the foreign subsidies received, the dissolution of a merger or a reduction of investments. Although it introduces very powerful tools, the Regulation also creates an administrative burden for both companies and the services of the European Commission.
