Abstract

The present study aims to analyze the decision of the European Court of Justice in terms of the legal clarifications it brings, namely those that it could or should have brought in relation to the screening mechanisms established by Regulation 2019/452 of 19 March 2019 establishing a framework for the screening of foreign direct investments into the Union, on the one hand, and the manner in which the EU judge strengthens his principle approach in the field of fundamental freedoms and the margin of appreciation of the Member States concerning their interference with the national measures, on the other hand.
