The application of the audi et alteram partem principle regarding the rights of business actors in resolving consumer disputes through the BPSK (Consumer Dispute Resolution Agency)

The problem addressed in this study is the implementation of the audi et alteram partem principle regarding the rights of business actors in consumer dispute resolution through the Consumer Dispute Resolution Agency (BPSK). This study aims to examine the implementation of the audi et alteram partem principle as well as the legal remedies available should this principle not be applied in dispute resolution at the BPSK. The research employs a normative legal method. The results show that the audi et alteram partem principle is a fundamental principle that guarantees the parties' right to be heard in a balanced manner during the dispute resolution process. In practice, the application of this principle at the BPSK has not been fully optimal, as decisions are still found to be rendered without giving one of the parties the opportunity to present a defense. In response to such violations, business actors may file an objection with the District Court as a form of legal protection to ensure certainty, fairness, and equality of rights for the parties in the dispute resolution process.
