Abstract

[eng] Transferring reference quantities between milk producers - The milk quota problem has been dealt with by a great number of jurists. Some of them connect the quota with the land, others think it's a patrimonial right being part of the producer's delivery contract, others, lastly, consider it's an incorporai right or even a simple administrative permission. Professional organizations have adopted opposing stands in favour of the link with the land for some of them with the producer for the others. The French governe- ment adopted provisions to allow direct transfer of the reference quantity to the successor of the disposer providing that he stays on the farm. In some cases, the french autorities provided also for withdrawals of reference quantity to be credited to the national reserve and used later for reallaction.
