Abstract

[eng] Transfering civil servant's retirement rights within the European Union . Since January, 1st. 1993, nationals from European Union Member States can move freely in Member States. . Beyond expatriation related problems, mobility changes concerning labour social security issues seem to be difficult to be dealt with unless there is a relative standardization of systems. However the established rule is that of « convergence », by which each country can align itself at its own pace with a standard defined as the smallest common denominator, which can evolve, and such a mechanism does not however lead to a regression for those in the front rank. Under these conditions, trade flows among countries could remain at a very low level unless some measures are taken to favour these flows. Regulation 1408/71 provides for a co-ordination applicable to different social security branches, but leaves special health insurance schemes and mutual insurance systems out of its field of application. Based on each one of its member's experience, the European Club of civil servants retirement plans has considered potential solutions to answer to civil servant's mobility, which is by now easily attainable. For the time being, it would seem that the Commission's choice goes towards the regulation 1408/71 being extended. [fre] Depuis le 1er janvier 1993, les ressortissants des pays membres de l'Union européenne peuvent circuler librement dans les pays membres. Au-delà des problèmes que peut poser une expatriation, les changements que la mobilité occasionne en matière de couverture sociale des travailleurs, semblent être un obstacle difficile à surmonter sans une relative mise en harmonie des régimes. Cependant, la règle établie est la « convergence », principe supposé permettre à chaque pays de s'aligner à son propre rythme sur un standard défini comme étant le plus petit dénominateur commun, évolutif, sans que cela conduise à une régression de ceux qui se situent au-delà. Dans ces conditions, les flux d'échanges entre pays pourraient rester à des niveaux très faibles si des mesures n'étaient pas adoptées pour favoriser de tels échanges. Le règlement 1408/71 organise une coordination applicable aux différentes branches de la Sécurité sociale, mais exclut de son champ d'application les régimes spéciaux et les régimes complémentaires. Le club européen des régimes de retraites d'agents publics a étudié, à partir de l'expérience de chacun de ses membres, des solutions possibles pour répondre à la mobilité désormais possible des fonctionnaires. Dans l'immédiat, il semblerait que le choix de la Commission s'oriente vers une extension du règlement 1408/71. de son champ d'application les régimes spéciaux et les régimes complémentaires. Le club européen des régimes de retraites d'agents publics a étudié, à partir de l'expérience de chacun de ses membres, des solutions possibles pour répondre à la mobilité désormais possible des fonctionnaires.
