Abstract

[fre] Cet article étudie de manière quantitative et qualitative l'impact des conflits juridiques liés aux droits de propriété intellectuelle dans l'industrie pharmaceutique et biotechnologique. Dans un premier temps, une étude d'événements est réalisée à partir de 158 communiqués de l'agence Reuters afin de mesurer les répercussions des procès sur les rentabilités boursières des firmes. Dans un second temps, une étude qualitative décrit les différents types de conflits et les stratégies d'acteurs qui s'y révèlent. [eng] This article considers the legal conflicts related to intellectual property rights in the pharmaceutical and biotechnology industry. The first part of the paper uses the event study methodology to assess the impact of these conflicts on the market value of the litigants. In the second part, we consider several distinctive features of these conflicts as well as the litigation and settlement strategies followed by opponents.
