Abstract

[fre] C'est dans les Lectures on Jurisprudence que Smith s'efforce le plus conséquemment de développer une théorie des droits naturels, en particulier, une théorie des « droits parfaits », dont la préservation « est le premier et le principal dessein de tout gouvernement civil ». Le domaine couvert est la démarche empruntée par Smith suggèrent qu'il prend très au sérieux l'idée de droits moraux, qui permettraient d'évaluer l'action gouvernementale, sans pour autant se confondre avec des règles tendant à promouvoir l'efficacité économique. Malheureusement, les notions clé mises en œuvre par Smith : attente raisonnable et attachement, sont foncièrement ambiguës. [eng] Smith on natural rights. . In Smith's Lectures on Jurisprudence we find his most extensive effort to develop a theory of natural rights, in particular, a theory of the « perfect rights », the preservation of which is « [t]he first and chief design of all civil government ». The extent and direction of Smith's effort strongly suggests that Smith took very seriously the idea of moral rights that provided criteria for evaluating governmental action and which were not merely rules for the promotion of economic efficiency. Unfortunately, the key notions which Smith employed in his efforts, i.e., the notions of reasonable expectation and of attachment, are deeply amiguous.
