Sur La Force Obligatoire Des Décisions De La Cour Constitutionnelle De La Roumanie

Abstract

Avec le constat de l'inconstitutionnalité des normes juridiques concernant l'écoute et enregistrement des conversations téléphoniques, ou audio-vidéo, des conversations ambientales, la localisation ou la traque par GPS et toute autre moyen électronique de supervision, on a posé la question concernant l’art. 147 al. 4 de la Constitution de la Roumanie, concernant les effets des décisions de l'admission de l’exception d'inconstitutionnalité, plus précisément de savoir si leur force obligatoire a un caractere uniquement ex nunc ou aussi ex tunc.
