La Non-Participation Du Procureur Competent – Aspects Theoriques Et Pratiques, Consequences

Abstract

Quand la participation du procureur au jugement des causes est obligatoire, son absence ou la participation d'un procureur incompétent entraîne la nullité absolue de la décision rendue dans le dossier. Le procureur est obligé de vérifier sa propre compétence et participer seulement dans les causes ou l'acte introductif d'instance a été réalisée par le parquet spécialisé dont il fait partie, selon le cas il peut s’agir d'un parquet "normal" ou les parquets spécialisés DIICOT ou DNA. Le respect de ces obligations concernant la participation et compétence du procureur pour instruire des cas liés aux certaines infractions spécialisées (crime organisée pour la DIICOT ou corruption pour la DNA respectivement) représente le respect incontournable du droit a un proces équitable.
