Abstract

La loi du 6 aout 2015 sur « La croissance, l’activité et l’égalité des chances », dite loi Macron, réforme certaines professions réglementées, notamment les professions juridiques. Rappel des conditions de vote de cette loi : délais, discussions, commission ex ante d’évaluation, vote bloqué. 1.Vers une liberalisation au nom de l’efficacite economique 1.1Les objectifs poursuivis Fin des monopoles. Libre concurrence. Egalité des chances, notamment pour les jeunes. Des finalités économiques. Concurrence et qualité du service rendu. 1.2 Les principales réformes Fin de l’autorégulation par les ordres professionnels. Deux exemples : réforme du notariat ; réforme des taxis et autocars. 2.Les ambiguités d’une liberté du marché réglementé par l’Etat 2.1 Libéralisation ou planification La tradition « colbertiste » de la France. Le rôle du ministere de l’Economie et des Finances et l’effacement du ministere de la Justice. 2.2 Les pouvoirs de l’Autorité de la concurrence Une autorité administrative indépendante aux pouvoirs accrus.Constitutionnalité (décision du Conseil constitutionnel du 5 aout 2015) et conventionalité (la loi et le droit de l’Union européenne). Conclusion: Une loi de circonstance et une mini réforme
