L’Inefficacite Du Droit En Certains Moments Et Contextes Sociaux

Abstract

Les phénomenes désorganisés sous forme de crises politiques au niveau national et international, les convulsions sociales, les phénomenes de migration et d’urbanisation, les inégalités sociales devenues de plus en plus nombreuses et expressives affectent la protection et la garantie des droits de l’homme qui parait etre en impasse. Qu’est-ce qui détermine – dans ces contextes – les Etats de respecter le droit, de protéger et garantir les droits subjectifs de leurs propres citoyens? „La réponse simple a cette question est que les Etats respectent le droit parce qu’ils considerent cette conduite comme avantageuse”. Le respect du droit international est la solution rationnelle, avantageuse pour chaque Etat, parce que les acteurs sur la scene internationale ne trouvent toujours les solutions raisonnables aux problemes qu’ils doivent résoudre. Il y a de nombreux exemples quand ni cette logique, ni le droit, ni la protection des droits de l’homme ne sont pris en considération pour motiver certaines décisions de politique externe.
