La Convention Europeenne Des Droits De L’Homme Et La Constitution Albanaise Actuelle

Abstract

Dans le but d’analyser comment les standards de la Convention européenne des droits de l’homme et spécialement ceux qui traitent de la question du droit a la vie sont intégrés et respectés dans le systeme interne normatif albanais, il serait important d’expliquer quelle est la place qu’occupe la Convention européenne des droits de l’homme dans le systeme normatif albanais. La Convention européenne des droits de l’homme fait partie du droit international. Dans cette optique elle doit etre traitée comme un simple traité international signé et ratifié par un État (dans notre cas par la République d’Albanie). Étant donnée la place spécifique de la Convention européenne des droits de l’homme dans la législation albanaise, mais aussi dans le but de ce travail, il est important d’analyser sa position dans l’ordre juridique interne albanais. Dans cet article je voudrai montrer la place de la C.E.D.H. (et spécialement du principe du droit a la vie prévu a l’article 2) dans la Constitution actuelle albanaise.
