Abstract

In a globalization period, present changes affect more than a single domain, such as the one of law. Our economic certainties and landmarks have changed without rendering a clearly shaped future. The recent economic crisis has revealed that also states have undergone speculative attacks. Wishing to impose market rules, the states have found themselves troubled by markets, thus exposing the powerlessness of their own governments. Therefore we have to reconsider this slow deterioration of public actions and the uncertainties of the economic perspectives. The issue regarding the state’s economic role concerns not only its extent, but also the way this role is exercised: hence the debate has become the most valuable possession of the state. The evolution of the economic deficit indicates that the regulatory power of the state has been reduced. All over the world, the policies of reducing public expenditures and debts have become priorities. The main issue is represented by the efficiency of the state’s role. The financial and economic crisis has revealed the image of a state as holder of promises facing markets’ malfunction.
