Derecho del trabajo y economía de mercado: ¿términos compatibles?

Abstract

Si bien es cierto que aún son necesarios algunos cambios de la legislación laboral peruana para adecuarla a las necesidades económicas y sociales del país, también es cierto que últimamente se ha avanzado en este sentido. Nuestras normas constitucionales son suficientemente flexibles como para admitir tales modificaciones, incluso cuando ellas puedan implicar un cambio de estructura misma de algunos de los derechos laborales. Prueba de ello son no sólo las recientes modificaciones legislativas en materia de compensación por tiempo de servicios y negociación colectiva, sino la clara posibilidad constitucional de modificar sustancialmente el actual sistema de estabilidad laboral.
