Concession in the port industry as a form of public-private partnership

Abstract

The article shows that a concession is a grant to meet public needs by an authorized executive body or local government body on the basis of a concession agreement on a paid and term basis to a legal or natural person (business entity) the right to create (build) and ( or) management (operation) of the concession object (term paid possession), provided that the business entity (concessionaire) undertakes obligations to create (build) and (or) manage (operate) the concession object, property liability and possible business risk; it is determined that the concession is one of the effective tools for upgrading the port infrastructure; the main organizational types of concessions are considered, the advantages of concessions in seaports are determined; international experience has been analyzed, which has shown that the involvement of private entities both in the direct implementation of economic activities and in the creation and modernization of seaport infrastructure greatly increases the profitability of the latter; based on the analysis of world experience, the factors that should be taken into account when determining the term of the concession and the amount of payments are also determined; it is established that the concession, as well as any investment project, is accompanied by a significant group of risks that may affect its profitability and efficiency. The example of the transfer of the Kherson Sea Commercial Port to the concession shows that the transfer of the port by the state to the concession will allow to fully use its potential and, ultimately, to restore port facilities that have been in decline for many years, as well as significantly improve the city's infrastructure. One of the main advantages of the concession is that the objects of the enterprises in which the concessionaire invests remain the property of the state. At the same time, concession payments to the budget come independently of the results of its commercial activities У статті розкривається, що концесія – це надання з метою задоволення громадських потреб уповноваженим органом виконавчої влади чи органом місцевого самоврядування на підставі концесійного договору на платній та строковій основі юридичній або фізичній особі (суб’єкту підприємницької діяльності) права на створення (будівництво) та (або) управління (експлуатацію) об’єкта концесії (строкове платне володіння), за умови взяття суб’єктом підприємницької діяльності (концесіонером) на себе зобов’язань щодо створення (будівництва) та (або) управління (експлуатації) об’єктом концесії, майнової відповідальності та можливого підприємницького ризику; визначено, що концесія є одним із ефективних інструментів оновлення портової інфраструктури; розглянуто основні організаційні типи концесій, визначено переваги концесії в морських портах; проаналізовано міжнародний досвід, який засвідчив, що залучення приватних суб’єктів як до безпосередньо здійснення господарської діяльності, так і до створення й модернізації інфраструктури морських портів надзвичайно підвищує прибутковість останніх; на основі аналізу світового досвіду також визначено чинники, які слід ураховувати при визначені терміну концесії та розміру платежів; установлено, що концесія, як і будь-який інвестиційний проект, супроводжується значною групою ризиків, що можуть вплинути на її прибутковість та ефективність; на прикладі передачі в концесію ДП «Херсонський морський торговельний порт» та ДП «СК» «Ольвія» показано, що передача державою портів в концесію дасть можливість повною мірою використовувати їх потенціал і відновити інфраструктуру портових об’єктів, що були в занепаді багато років поспіль, а також значно поліпшити інфраструктуру міст, де розташовані ці порти. Одна з головних переваг концесії – об’єкти підприємств в які інвестує концесіонер залишаються у власності держави. В той же час, концесійні платежі до бюджету надходять незалежно від результатів його комерційної діяльності.
