Öffentliche Dienstleistungen in EU-Freihandelsabkommen

Abstract

The current controversy about the free trade agreements of the EU with Canada (CETA) and the US (TTIP) also concerns the potential impact of these agreements on public services. The present contribution discusses how free trade agreements influence the organization and provision of public services and which treaty terms reduce or exclude such an influence. The core of this contribution is a general model of analyzing the impact of free trade agreements on public services. This model is then applied to CETA and TTIP. On this basis, it will be shown that general principles of free trade agreements may make certain models of supplying public services difficult if there are no or insufficient provisions protecting public services.
