Handlungsspielräume für Tarifparteien und Interessenvertretungen bei der Arbeitszeitgestaltung

Abstract

Aus Anlass der positiven ökonomischen Wirkungen von Arbeitszeitflexibilität in der Wirtschaftskrise stellt der Beitrag den rechtlichen Rahmen dar, in dem sich die betrieblichen und tariflichen Akteure bewegen können. Hierbei liegt der Akzent des Arbeitszeitrechts auf dem Schutz der Arbeitnehmer vor den Gefahren flexibler, insbesondere langer Arbeitszeiten. Die Akteure der Mitbestimmung haben im Rahmen von Tarifverträgen und Betriebsvereinbarungen große Gestaltungsmöglichkeiten, damit allerdings auch die Verantwortung, den Gesundheitsschutz ernst zu nehmen. Zu leicht dominiert in flexibilisierten Arbeitszeitregimes das Interesse der Arbeitgeber an längerer Arbeit oder der implizite Anreiz zur Selbstausbeutung.
