Der deutschen Unternehmensmitbestimmung entzogen: Die Zahl der Unternehmen mit ausländischer Rechtsform wächst

Abstract

Wenngleich sich das deutsche Modell der Mitbestimmung auf Unternehmens- und Betriebsebene international bewährt - wie erst kürzlich die sozialpartnerschaftliche Bewältigung der Wirtschaftskrise erneut zeigte -, verschwindet die Sorge vor einer schleichenden "Flucht aus der Mitbestimmung" nicht. Eine Lücke in den Mitbestimmungsgesetzen erlaubt es in Deutschland ansässigen Unternehmen in ausländischer Rechtsform, keinen mitbestimmten Aufsichtsrat zu bilden. Der Beitrag erfasst die Entwicklung bis Oktober 2010 und aktualisiert damit eine Empirie, die im Rahmen der Biedenkopfkommission 2006 begonnen und seither mehrfach erneuert wurde. Die Ergebnisse bestätigen den seit Jahren konstatierten Trend eines stetig wachsenden, aber immer noch überschaubaren Felds außerhalb der Unternehmensmitbestimmung: In 43 Unternehmen ausländischer Rechtsform mit mehr als 500 Arbeitnehmern in Deutschland finden die gesetzlichen Regeln zur Arbeitnehmerbeteiligung im Aufsichtsrat keine Anwendung - eine Zunahme um 26 Fälle seit 2006. in: WSI-Mitteilungen 1/2011, Seiten 34-40
