Arbeitnehmerbeteiligung in mittelständischen Unternehmen

Abstract

Der vorliegende Beitrag setzt sich mit individuellen und kollektiven Formen der Interessenvertretung von Arbeitnehmern im Mittelstand auseinander. Mittels einer schriftlichen Unternehmensbefragung sowie Fallstudien kann gezeigt werden, dass es sehr verschiedene Formen der Interessenvertretung in den mittelständischen Unternehmen gibt. Sie unterscheiden sich vor allem im Ausmaß, in dem Beteiligungsrechte in Anspruch genommen werden. So werden in einigen Unternehmen, in denen ein Betriebsrat existiert, nicht alle im Betriebsverfassungsgesetz verankerten Rechte vom Betriebsrat tatsächlich genutzt. In anderen Unternehmen wird dagegen der Betriebsrat über das Betriebsverfassungsgesetz hinaus beteiligt. Gleichzeitig gibt es eine Reihe von mittelständischen Unternehmen, in denen kein Betriebsrat existiert. In einigen dieser Unternehmen gibt es andere Formen der individuellen und kollektiven Interessenvertretung, die durchaus Parallelen zu Betriebsratsstrukturen aufweisen.
