Europäische Betriebsräte: Was lehrt der deutsche Fall für die Revision der EU-Richtlinie?

Abstract

Die Europäische Kommission ist aktuell bestrebt, die EU-Richtlinie über Europäische Betriebsräte (EBR) zu überarbeiten. Mit dieser Reform soll auf Probleme reagiert werden, die sich in der Praxis seit Inkrafttreten der EBR-Richtlinie im Jahr 1994 ergeben haben. Der Beitrag geht zunächst auf die aktuelle quantitative Verbreitung von Euro-Betriebsräten in deutschen Unternehmen sowie auf das Problem der sogenannten "Deckungsquote" ein. Anhand der methodischen Erhebungsschwierigkeiten identifizieren die Autoren Umsetzungsprobleme bei der praktischen Einrichtung von europäischen Betriebsräten. Die drei relevanten Problemzonen der Praxis der "alten" EBR-Richtlinie in deutschen Unternehmen sind: Unternehmensübernahmen und -fusionen, uneinheitliche EBR-Strukturen in manchen Unternehmen sowie die für Deutschland spezifische Situation in Eigentümerunternehmen. Sie werden anhand von exemplarischen Fällen aus der Erhebung verdeutlicht. Der Beitrag endet damit, aus den Befunden Schlussfolgerungen für die Revision der EU-Richtlinie abzuleiten und weiteren Forschungsbedarf zu skizzieren.
