The Adoption of a Eu Regulatory Sandbox on the Way to RegTech 3.0

Abstract

First of all, the paper covers the essential traits of the RegTech phenomenon, bearing in mind its goals, and the steps of development that led to the latest trends, with particular regard to regulatory sandboxes. On the basis of an analysis of the peculiarities of sandboxes, the distinguishing features of the relevant regulations, namely the English and the Italian regulations (Law 58/2019, which converts Law Decree 34/2019, the socalled «Decreto Crescita»), are tackled, with a focus on the key aspects of sandboxes in Italy. The comparative analysis and the considerations of the entire system lead to the proposal of harmonizing the system among all European regulations and, therefore, of harmonizing the specific provisions on sandboxes throughout the European Union.
