The Struggle for a Legal Model Regarding Gas Distribution: A Comparison with England and France

Abstract

A causa di un quadro regolatorio incerto, caratterizzato da continui rinvii e modifiche, la modalità di organizzazione del servizio di distribuzione del gas naturale per ambiti territoriali stenta ad affermarsi nel nostro ordinamento. Le scelte operate dal legislatore italiano sembrano avvalorare l'ipotesi della progressiva costruzione di un modello sui generis, che segna le distanze con l'assetto previgente e, al contempo, presenta profili di originalità rispetto ad altre e più consolidate esperienze nel panorama europeo. Il presente articolo si prefigge di evidenziare le peculiarità e le criticità del modello nostrano attraverso il raffronto con le scelte antitetiche operate da due ordinamenti: l'ordinamento inglese, che ha prodotto un modello dalla forte impronta privatistica, e l'ordinamento francese, che ha concepito un modello dalla forte impronta pubblicistica.
