Markets Regulation and Supervision: The Role of ISVAP/IVASS

Abstract

L'articolo anzitutto delinea gli obiettivi e le finalità della vigilanza in ambito assicurativo, evidenziando poi come anche l'attività di supervisione pubblica in questo specifico comparto dell'ordinamento finanziario - al pari di quanto accade con riferimento alle banche e alle imprese di investimento - debba confrontarsi con taluni modelli organizzativi, non necessariamente tra loro alternativi. Nel prosieguo della trattazione, l'A. ripercorre quindi l'evoluzione della disciplina italiana della vigilanza assicurativa, soffermandosi su alcuni passaggi salienti e inscrivendo quest'ultimi nel più ampio processo di trasformazione in corso a livello europeo. La ricostruzione compiuta mira a tratteggiare le specificità della vigilanza rispetto alle imprese di assicurazione, che l'A. rileva essere perfettamente allineata alle peculiarità dell'attività esercitata dai soggetti vigilati.
