The Italian Antitrust Authority's Guidelines on the method of setting fines: A good, or nearly good, first take

Abstract

Il contributo analizza nel dettaglio, da un punto di vista critico e sistematico, le prime Linee Guida nazionali in tema di quantificazione delle sanzioni antitrust, adottate dall'Autorità garante della concorrenza e del mercato (l'«Autorità») nell'ottobre 2014. A tal fine, il punto di partenza dell'analisi è costituito da un confronto tra le Linee Guida e gli Orientamenti della Commissione europea per il calcolo delle ammende nei procedimenti antitrust, mettendo in luce relative affinità e divergenze. Un'attenzione speciale è dedicata agli aspetti di novità contenuti nelle Linee Guida: questi consistono, da un lato, in una serie di criteri ben definiti per la quantificazione pratica delle ammende antitrust, che in tal senso costituiscono un esercizio di autolimitazione, da parte dell'Autorità, della propria discrezionalità, e, dall'altro, in specifiche e interessanti previsioni in tema di circostanze attenuanti e aggravanti. Pur apprezzando complessivamente il valore di tale nuovo strumento di "soft law", gli autori non mancano altresì di formulare alcune considerazioni e spunti in chiave critica rispetto a taluni specifici profili e, più in generale, rispetto al (debole) raccordo sistematico del testo delle Linee Guida con la disciplina generale dettata dalla l. 689/1981 in materia di sanzioni amministrative.
