Whistleblowing: The words and the things

Abstract

Le pratiche di "whistleblowing", ovvero la segnalazione protetta (ed eventualmente remunerata) di illeciti da parte di soggetti che dispongano di informazioni qualificate al riguardo, stanno assumendo un rilievo crescente nel contrasto a determinate violazioni di legge, in particolare corruzione ed evasione fiscale. L'articolo ripercorre i riferimenti principali del tema, a partire dalla disciplina vigente negli Stati Uniti e con cenni all'esperienza del Regno Unito, soffermandosi sulla situazione italiana. Oltre alla proposta di utilizzo di un nuovo termine per individuare il soggetto attivo nella segnalazione («relatore»), alcune riflessioni operative e proposte di riforma sono espresse al termine della ricerca.
