Waiting for Huawei Technologies: Standards, SEPs and F/Rand Commitments

Abstract

Per neutralizzare i rischi di "hold up" le SSOs sono solite ricorrere, oltre a prescrizioni informative ("disclosure rules"), anche a licensing rules, richiedendo ai partecipanti l'impegno a licenziare ogni brevetto essenziale ai fini dello standard a condizioni ragionevoli e non discriminatorie (F/Rand). Tanto serie sono le implicazioni del relativo "commitment" quanto vago è il suo contenuto: l'incertezza riguardo il contenuto prescrittivo degli impegni F/Rand ha un rilievo significativo alla luce delle numerose controversie insorte negli ultimi anni e della domanda di fondo se la violazione di un impegno F/Rand determini una responsabilità antitrust.
