Esselunga v. Coop Estense and the supermarkets war: the abuse of dominant position as abuse of right

Abstract

La sentenza del Consiglio di Stato n. 1673/2014 ruota soprattutto intorno a un unico, ma fondamentale aspetto: la qualifica dell'abuso di posizione dominante in termini di illecito di mera condotta oppure di illecito di evento. A sua volta, tale aspetto risulta indissolubilmente connesso alla problematica relativa alla nozione di abuso (o di sfruttamento abusivo) di posizione dominante, la cui individuazione, da sempre, è stata rimessa alla prassi decisionale della Commissione e alla giurisprudenza del giudice europeo, sulla cui elaborazione, peraltro, la dottrina non ha mancato di evidenziare numerosi profili di criticità. La pronuncia del Consiglio di Stato, pertanto, fornisce lo spunto per una ricognizione su uno degli aspetti relativi all'istituto dell'abuso di posizione dominante maggiormente controversi e dibattuti.
