Abstract

Il contributo analizza criticamente la pronuncia della Corte di Giustizia UE, che ha fornito risposta a numerose domande pregiudiziali sottoposte dall'Alta Corte di Giustizia inglese attinenti alle modalità di cessione e sfruttamento dei diritti sulle manifestazioni sportive tra la Lega inglese, FAPL, e le emittenti di radiodiffusione, in primis BSkyB. In particolare, viene posta enfasi sugli aspetti di natura concorrenziale relativi all'apposizione delle clausole di esclusiva territoriale, solitamente presenti negli accordi tra le parti, così come agli elementi critici nella prospettiva del rafforzamento del mercato comune europeo associati alle forme di sfruttamento della proprietà intellettuale.
