Abstract

Il contributo analizza la recente sentenza Credit Suisse con cui la Corte Suprema statunitense ha definito in via più restrittiva l'ambito di applicazione del diritto antitrust nel mercato dei valori mobiliari. La sentenza si segnala non solo per il suo esito, ma anche per le nuove argomentazioni svolte dalla Corte per giustificarlo, argomentazioni che rievocano gli insegnamenti della Scuola di Chicago e che trovano nelle specificità dei mercati finanziari importanti fattori esplicativi.
