Abstract

Con ogni probabilità, l'unico dato positivo della decisione resa dal Tribunale di Primo Grado nel caso Microsoft europeo è il fatto stesso che una vicenda durata nove anni sia finalmente giunta al termine. Peraltro, la soluzione divisata dal Tribunale appare ancor più problematica della (già acrobatica) decisione della Commissione, che risale al 2004. Gli autori analizzano il contenuto della sentenza del Tribunale, con particolare riferimento all'applicazione del test di Magill/IMS, l'interpretazione del concetto di interoperabilità, il c.d. "new product screen" e la complessa interazione tra "esercizio normale" dei diritti di proprietà intellettuale e scrutinio antitrust. Ne emerge un quadro a tinte fosche, soprattutto per quanti auspicavano che l'antitrust comunitario evolvesse verso un "more economic approach".
