I nuovi poteri cautelari dell'AGCM tra diritto comunitario e diritto interno

Abstract

Tra le novità introdotte dal primo "pacchetto Bersani" per rafforzare la tutela della concorrenza e del mercato spicca l'attribuzione all'AGCM di poteri cautelari che possono essere adottati "nei casi di urgenza dovuta al rischio di un danno grave e irreparabile per la concorrenza" (art. 14-bis, comma 1). Si tratta, peraltro, di una competenza che già il regolamento n. 1/2003 aveva concesso alle Autorità nazionali chiamate ad applicare nei rispettivi ordinamenti gli articoli 81 e 82 del Trattato e che era stata a sua volta riconosciuta in capo alla Commissione da parte della giurisprudenza comunitaria. Con questo provvedimento viene quindi colmata una lacuna che pone fine ad un'asimmetria normativa difficilmente giustificabile tra i poteri d'intervento dell'AGCM, da un lato, e quelli conferiti, rispettivamente, alla Commissione CE e all'Autorità giudiziaria ordinaria, dall'altro. L'articolo prende in esame i principi ricavabili dalla giurisprudenza comunitaria in materia di provvedimenti cautelari ponendoli a confronto con le prime esperienze applicative dell'istituto da parte dell'AGCM. In questa prospettiva, particolare attenzione viene dedicata ai requisiti del "fumus boni iuris" e del "periculum in mora" anche al fine di stabilire un raffronto con gli analoghi presupposti richiesti per la concessione di misure cautelari da parte del Giudice ordinario (art. 33, l. n. 287/1990). La conclusione è che un'applicazione coerente dell'istituto dovrebbe consentire di ridurre, se non di eliminare del tutto, le differenze che pure sussistono tra diritto comunitario e diritto nazionale in materia; ed in questo senso sembrerebbe orientata anche la recente comunicazione in tema di misure cautelari pubblicata dall'AGCM.
