The Rebirth of the Pro-Competitive Dimension of National Public Contracts: The Italian Administrative Judge’s Liberal Approach to the International Competition

Abstract

Con la sentenza n. 3721/2025, il Consiglio di Stato offre una lettura critica e demolitoria rispetto alle valutazioni del giudice di prime cure circa l’esclusione, da una procedura di gara pubblica, di una società italiana che si è avvalsa di un operatore cinese. La controversia verte sull’interpretazione pro-concorrenziale dell’avvalimento, inserito nel più ampio contesto dell’istituto dell’Accordo sugli Appalti Pubblici previsto dal d.lgs. 36/2023. Il Consiglio di Stato ha inteso ribadire l’interpretazione euro-unitaria di tale ultimo strumento, sottolineando le implicazioni sull’equilibrio concorrenziale che una lettura protezionistica avrebbe potuto generare. Il presente contributo, prendendo spunto dal caso di specie, si prefigge di esaminare la magnitudo del principio di concorrenza, rispetto a quello del risultato, le possibili distorsioni alla concorrenza internazionale nel mercato degli appalti pubblici, ormai globalizzato, indagando in particolare le potenziali tensioni emergenti dall’uso dello strumento dell’avvalimento nel contesto di un’economia multipolare.
