Market Power in Digital Markets beyond DMA: The Case of Enterprise Resource Planning

Abstract

I "software" gestionali rappresentano la vera ossatura di qualunque impresa moderna. L’analisi dei contratti per la fornitura di questi "software" evidenzia clausole tipicamente molto penalizzanti per le aziende clienti. Inoltre, la necessità di personalizzare tali "software", aggiornarli e manutenerli continuamente contribuisce a creare un costo idiosincratico elevatissimo che lega il cliente nella relazione con il suo fornitore. Questo crea un effetto di "lock-in" che sbilancia il potere contrattuale a favore del "vendor". Questo articolo descrive questa situazione, mostrandone alcune possibili chiavi di lettura in ambito antitrust. Se per la soluzione di questi problemi i tradizionali strumenti di intervento dell’antitrust possano essere sufficienti, resta una questione aperta.
