Unfair Terms and Consumer Protection Thirty Years after Directive 93/13: The Lost World ( J.e.l.: K12)

Abstract

Sono passati, ormai, più di trent’anni dall’entrata in vigore della Direttiva 93/13/CEE sulle clausole abusive stipulate con i consumatori: l’intervento, certamente ambizioso nei suoi obiettivi, si proponeva di correggere le inefficienze del mercato connesse all’affermarsi delle crescenti asimmetrie (di potere, e informative) proprie della contrattazione di massa nei contratti "business-to-consumer". Nel corso di questo tempo, la Corte di giustizia – alla ricerca di interpretazioni utili a garantire quell’«elevato livello di tutela» del consumatore che rappresenta l’obiettivo esplicito della Direttiva – ha sviluppato ed integrato profondamente il contenuto dell’"Unfair Contract Terms Directive", arrivando a porsi ortogonalmente alla giurisprudenza domestica e (forse) alle finalità stesse della disciplina. Che tale approccio si sia effettivamente tradotto in un aumento del "consumer welfare" – o, financo, in una promozione della giustizia contrattuale negli scambi – non è tuttavia certo: ciò, specialmente qualora si analizzi il tema del controllo di vessatorietà (e delle sue conseguenze rimediali) in una prospettiva di analisi economica del diritto, nonché in considerazione delle strategie di micro-segmentazione che caratterizzano gli odierni contratti del mercato digitale.
