Ever and Ever Again. Another Round for the by Object vs. by Effect Conundrum?

Abstract

Cos’hanno in comune uno scambio di informazioni tra enti creditizi e alcune clausole contenute nel regolamento Fifa afferenti alla disciplina sul trasferimento transfrontaliero dei calciatori professionisti? Entrambe le condotte, per il tramite della Corte di Giustizia, hanno dato nuova linfa all’infinito dibattito sulla distinzione tra restrizioni della concorrenza per oggetto e per effetto, facendo riflettere su una nuova spinta espansiva della nozione per oggetto al fine di catturare anche scambi di informazioni autonomi e clausole di c.d. "no poach", tradizionalmente sfuggite a tale qualifica. Tuttavia, più che chiarire, le sentenze in commento sollevano ulteriori domande circa l’appropriatezza di una simile categorizzazione, e gli standard probatori che dovrebbero soddisfarsi. L’articolo si propone di analizzare alcune delle sfide, pratiche e sistemiche, che potrebbero caratterizzare una simile scelta interpretativa.
