The Multifaceted Pro-Competitive Regulation of Cloud Services

Abstract

Il lavoro descrive, sotto un profilo tecnico-economico, le caratteristiche dei servizi cloud e dei mercati di riferimento, focalizzandosi sulle dinamiche concorrenziali per come valutate dalle analisi di mercato effettuate da varie autorità di concorrenza nazionali. Su questa base, il lavoro esamina in dettaglio i principali strumenti di regolazione pro-concorrenziale applicabili a questo segmento del mondo digitale, il "Digital Market Act" (Dma) ed il "Data Act" (Da), valutando la loro capacità di rispondere ai problemi concorrenziali evidenziati. Fra le varie valutazioni, da un lato, vengono descritte le ragioni che stanno alla base di una problematica applicazione del Dma ai servizi cloud; dall’altro lato, si evidenziano le possibili interazioni fra Dma e Da e si fornisce una loro lettura interpretativa coordinata. Infine, il lavoro considera le interazioni fra i servizi cloud ed i servizi e le reti di comunicazione elettronica, ragionando su una possibile armonizzazione delle regole, per come anche proposto dalla Commissione europea.
