The Role of Economic Analysis in Antitrust Enforcement

Abstract

Questa nota discute il ruolo dell’analisi economica e del surplus dei consumatori nell’intervento antitrust, considerati dai critici attuali i responsabili del debole livello di "enforcement" dell’intervento antitrust e della tendenza alla crescente concentrazione delle economie avanzate. La tesi proposta ricostruisce l’intero disegno dell’intervento a partire dalla prevalente visione della concorrenza, distinguendo l’approccio strutturalista, di Chicago e post-Chicago. Dalla visione della concorrenza vengono derivati l’obiettivo concreto dell’intervento, gli esiti attesi delle condotte, le associate presunzioni, assolute o confutabili, negative o positive, l’onere della prova e gli standard di prova volti a minimizzare gli errori di giudizio. Sulla base di questa ricostruzione vengono esaminate le critiche dell’approccio neo-strutturalista all’analisi economica e al surplus dei consumatori, che non colgono come il responsabile del debole "enforcement" sia l’assunto ideologico della Scuola di Chicago sull’efficienza e la capacità di autocorrezione dei mercati e non l’utilizzo del surplus dei consumatori. Inoltre, gli obiettivi proposti in alternativa al surplus dei consumatori, concentrazione, processo di mercato, competizione nei meriti appaiono di vaga definizione e non misurabili, dando basi incerte all’intervento antitrust.
