The Principle of Result in the Law of Public Procurement

Abstract

Il Codice dei contratti pubblici del 2023 ha introdotto alcuni princìpi innovativi, tra i quali, in primo luogo, il principio del risultato, che esprime la volontà del legislatore di enfatizzare la funzione principale dell’attività contrattuale – quella di ottenere i migliori beni o servizi al prezzo più conveniente – rispetto ad altri pur importanti interessi, come la tutela della concorrenza e la prevenzione della corruzione. Il testo esamina le ragioni che hanno condotto alla sua affermazione, il modo in cui esso è enunciato e articolato, il suo ambito di applicazione, l’incidenza potenziale e quella prevedibile. Si tratta di una norma che esprime un concetto forse ovvio, ma utile nell’attuale contesto normativo e amministrativo.
