Redistributive Efficiency and «Optional Law»: Law and Economics in the Italian Civil Code

Abstract

Il presente lavoro è il secondo tentativo di ricercare e valutare la c.d. optional law – impostazione giuseconomica basata sull’applicazione di regole opzionali che deriva da un’estensione del preminente lavoro di Calabresi e Melamed esposto nel celebre articolo One view of the Cathedral (1972) – al diritto civile italiano. Il tentativo è quello di condurre un’analisi economica su alcune norme, riguardanti la tutela della proprietà privata e i rapporti di vicinato, che sembrano contenere «opzioni put» – opzioni che innescano acquisti coattivi. Tale analisi è stata condotta secondo un modello di efficienza inedito che, a differenza dei già consolidati modelli di Pareto e di Kaldor-Hicks, tiene conto di elementi redistributivi. L’ulteriore scopo di questo studio è quello di caldeggiare il dialogo tra la disciplina economica e quella giuridica, in quanto scienze sociali in comunione d’intenti.
